Payment regulations of Academy of Physical Education in Katowice

§General provisions

1. These regulations specify the terms and conditions of handling single payments made electronically with the use of the Payment Gateway.

2. The terms used in the regulations shall mean:

a) AWF Katowice - Academy of Physical Education in Katowice ,72aMikołowska, 40-065 Katowice; telephone: +48 32 207 51 00; NIP: 6340195342; REGON: 000327882;

b) Payment gateway or Gateway - an Internet service allowing Academy of Physical Education Katowice to accept payments for services expressly indicated in these Terms of Use;

c) JHK - the publisher of the Journal of Human Kinetics;

d) Customer - a person, a legal person, an organisational unit without legal personality, with legal capacity, making payment for the services indicated in these Terms and Conditions through the Payment Gateway to Academy of Physical Education in Katowice.

e) Consumer - a person making a legal transaction not directly connected with his/her business or professional activity

3. In order to make a payment using the Payment Gateway, the user must be acquainted with the content of the present regulations and accept its provisions.

4. Academy of Physical Education Katowice is the owner of the Payment Gateway. In matters concerning the use of the Payment Gateway, one may contact via e-mail - pay@awf.katowice.pl.

5. In order to use the Payment Gateway it is necessary to have a device with access to the Internet and a working Internet browser.

6. Transmission of illegal content via Payment Gateway is prohibited.

§2 Subject matter of the service

1. The Payment gateway is used to make payments for:

2. Publication services provided by JHK;

3. Services provided by the Functional Research Centre operating within the Academy of Physical Education in Katowice.

4. Payment through the Payment Gateway may be made by all customers using the services referred to in section 1, on the basis of agreements concluded with Academy of Physical Education in Katowice. Terms of termination of such agreements are governed individually in each case.

5. In the case of publication services provided by JHK, payment through the Payment Gateway is made after approval of the article to be published in the journal and after receiving the publication number via e-mail from the appropriate Academy of Physical Education in  Katowice employee. In the case of services provided by the Functional Research Laboratory, payment is made after the service has been rendered, following approval of the fee by an authorised representative of the Functional Research Laboratory. In the case of pre-arranged examinations, the service may be paid for before it is performed.

6. Through the Payment Gateway it is not permissible to make any other payment for services other than those expressly indicated in these regulations. In particular, the Payment Gateway cannot be used to pay recruitment or educational fees provided by Academy of Physical Education in  Katowice to students, doctoral students, participants in postgraduate programmes or other forms of education. In the cases indicated above, payments are made:

7. In the case of application- payments are made to an individual account in the IRK system( the online registration of candidates)

8. In the case of educational services - payments are made to an individual account in the USOS system.

§3 Settlement of payments made via Payment Gateway

Payment through the Payment Gateway may only be made in accordance with the price lists available respectively for

a) publication services at: http://www.johk.pl;

b) services provided by the Functional Research Laboratory, operating within the structure of Academy of Physical Education in Katowice, at https://pbcz.awf.katowice.pl.

§4 Complaints

1. Payments for publications which are not identified will be referred for clarification. If, following clarification, it is not possible to allocate the payment to the service provided, the fee paid, less the amount of the commission, will be refunded to the account from which the transfer was ordered.
2. The Customer may file a complaint if a payment service performed with the use of the Payment Gateway has not been rendered or has been rendered incorrectly.
3. A complaint may be submitted in electronic form, to the e-mail address specified in §1 section 4 above, together with indication of the Customer's data, e-mail address to which a reply to the complaint is to be sent and a description of irregularities concerning the payment.
4. A complaint shall be considered as soon as possible, however, no later than within 14 calendar days of its submission. The reply to the complaint shall be sent to the Customer at the e-mail address indicated in the complaint.
5. A complaint shall be reviewed by an authorised person in accordance with the rules of operation of the appropriate unit or organisational unit of Academy of Physical Education in Katowice providing the service. In the event of a positive outcome of the complaint, appropriate action will be taken, appropriate to the situation (e.g. the service will be rendered or the payment refunded).

§5 Supported forms of payment

Payment through the Payment gateway can be made by credit card or electronic transfer through an external payment system imoje, operated by ING Bank Śląski S.A.

§6 Right of withdrawal from a distance contract

1. Subject to paragraphs 7 and 8, a Consumer who has concluded a distance contract, the subject matter of which was at least one of the services referred to in § 2 paragraph ,section 1 of these Terms and Conditions, may within 14 days withdraw from the contract without giving any reason and without incurring costs.
2. The period for withdrawal from the contract shall begin on the date of conclusion of the contract.
3. The declaration of withdrawal may be made in writing - in such a case, the declaration should be made in person at the registered office of Academy of Physical Education in Katowice or sent by registered mail to the address of Academy of Physical Education in Katowice as indicated in § 1,section 2,letter a of these rules or by e-mail sent to pay@awf.katowice.pl. Withdrawal from the contract may be made using the form constituting Appendix No. 2 to the Act of 30 May 2014 on Consumer Rights. This form is also attached to these Regulations.
4. In order to meet the deadline referred to in paragraph 1, it is sufficient to send the declaration before its expiry.
5. In case of withdrawal from the contract by the Consumer, the contract shall be deemed not to have been concluded.
6. Academy of Physical Education in Katowice shall promptly, but not later than within 14 days of receipt of the Consumer's declaration of withdrawal from the contract, refund all payments made by the Consumer. Academy of Physical Education in Katowice shall reimburse the payment using the same method of payment used by the Consumer, unless the Consumer expressly agrees to a different method of reimbursement that does not incur any costs for the Consumer.
7. Where, at the express request of the Consumer, Academy of Physical Education in Katowice has commenced performance of the service before the expiry of the withdrawal period and the Consumer has subsequently withdrawn from the contract, the Consumer shall be obliged to pay for the services performed up to the time of withdrawal.
8. The right of withdrawal from a service contract shall not apply if Academy of Physical Education in Katowice performs the service in full with the express consent of the Consumer who has been informed prior to the commencement of performance that, after Academy of Physical Education in Katowice has performed the service, he/she will lose the right to withdraw from the contract.
9. The provisions relating to the right of withdrawal from a distance contract concluded by the Consumer contained in this paragraph shall also apply to a natural person who concludes a distance contract directly related to their business activity, when it follows from the content of the contract that it is not of a professional nature for that person, resulting in particular from the subject of their business activity, made available on the basis of the provisions on the Central Register and Information on business activity.

§7 Final provisions

1. Academy of Physical Education in  Katowice is the administrator of the Customers' personal data. All information on the principles of processing the personal data of the customers by Academy of Physical Education in  Katowice, as well as the rights to which the customers are entitled in connection with such processing, can be found in the Privacy Policy, available at: https://pay.awf.katowice.pl/en/privacy-policy.

2.The law applicable to any claims that may arise in connection with payments made using the Payment Gateway is the Polish law.

3. In matters not regulated by these Terms and Conditions, the relevant provisions of generally applicable law shall apply.

4. Subject to the following sentence, all disputes related to the execution of payments using the Payment Gateway shall be settled by the Polish common court of law having jurisdiction over the registered office of Academy of Physical Education in Katowice. Where payment has been made by a consumer or a person referred to in § 6, section 9 of these Terms and Conditions, any disputes related to the execution of payments using the Payment Gateway shall be settled by a common court with jurisdiction over the seat of the consumer or the aforementioned person.
